Chief Justice to set up new panel to hear Senate President’s case

The CJN is expected to dissolve the Supreme Court panel which granted a stay of proceedings in Saraki’s favour on Thursday, November 12, 2015.

The Chief Justice of Nigeria (CJN), Justice Mahmud Mohammed, will soon set up a new panel to hear the appeal filed by Senate President Bukola Saraki against his trial at the Code of Conduct Tribunal (CCT), reports say.

The CJN is expected to dissolve the Supreme Court panel which granted a stay of proceedings in Saraki’s favour on Thursday, November 12, 2015, Punch reports.

Saraki is urging the apex court to throw out the case against him due to lack of jurisdiction on the part of the tribunal.

The Senate President has been accused of false asset declaration among other charges.

“With the public interest in the case and coupled with the retirement of Justice Fabiyi next week Wednesday, the panel has to be disbanded,” a source told Punch.

“It is the practice of the Supreme Court that when a number of contentious constitutional issues are raised in an appeal such as this one (Saraki’s case), the CJN is likely to head such appeal panel,” the source added.

A number of lawyers had reacted to the stay of proceedings saying that the Supreme Court was out of order in granting it.
