An Egor Magistrates’ Court in Benin on Thursday jailed a 24-year-old Man, Jolly Agbontaen, to eight years imprisonment for raping a 23-year-old girl.

The prosecutor, ASP Osas Osarentin, had earlier told the Court that the accused was arraigned on a three-count charge of rape, stealing and assault.

Osaretin said the accused committed the crime on Aug. 21, 2013, at about 8:45pm, along Eben-Obasuyi St., off Textile Mill Road in Benin.

He alleged that the accused forcefully had canal knowledge of his victim against her will.

The prosecutor said the offence contravened Sections 358, 309 (9) and 351 of the Criminal Code Cap. 48 Vol. ll laws of the defunct Bendel State of Nigeria 1976 as applicable in Edo.

Delivering judgment, the Chief Magistrate, Mrs Igho Braimoh convicted Agbontaen on counts one and three but discharged him on count two.

The magistrate therefore sentenced the convict to seven years imprisonment on count one and another one year on count three respectively.

Braimoh ruled that the sentence would run concurrently.
