APC candidate sued again over credentials

A Federal High Court in Abuja, on Monday, February 2, ordered that court papers be served on Buhari for the new case against him instituted by one Max Ozoaka.

A fresh suit has been instituted against the Presidential candidate of the All Progressives Congress (APC), Muhammadu Buhari in a bid to have him disqualified from the upcoming polls.

A Federal High Court in Abuja, on Monday, February 2, ordered that court papers be served on Buhari for the new case against him instituted by one Max Ozoaka.

Ozoaka wants Buhari to be disqualified for failing to submit his academic credentials to the Independent National Electoral Commission (INEC) along with his nomination form. INEC is a co-defendant in the case.

Ozoaka insists in his suit that the form submitted by Buhari was incomplete and as such should be declared “incompetent some being inchoate and not in conformity with the form prescribed under the Electoral Act.”

The presiding judge, Justice Adeniyi Ademola, made an order for substituted service of the papers on Buhari.

Substituted service is usually invoked in instances where it would be difficult to serve a defendant in person.

The court will begin hearing the case on February 9.

An initial suit was instituted against Buhar by Abuja-based lawyer, Chike Okafor who accused the former Head of State of falsifying information on an affidavit submitted to INEC.

Buhari had told INEC that his certificates were in the possession of the military but the army has denied this

The Presidential candidate then authorized his secondary school to release in a bid to silence his critics.

INEC has also said that it can not disqualify Buhari and that all aggrieved parties should take their grievances to the courts.
