The victim identified as Christopher Johnson, reportedly sued the Harris County sheriff's office claiming that he was brutally attacked and his mug shot, which has been released following the lawsuit is simply incriminating.
The mug shot shows Johnson smiling as the arms of two men can be seen holding him by the neck.
Johnson claims that the officers had gotten upset because he was smiling for the shot so they decided to strangle him, adding that he is lucky to be alive.
His lawyer says that the event caused Johnson significant pain as well as mental anguish, adding that his civil rights were violated and are therefore seeking compensation and punitive damages.
Although a police report accused Johnson of being uncooperative at the time, he has refuted the claims as his smile in the shot further supports his claims.
