According to the indictment, the incident occurred in the early hours of June 24th in the men's restroom of the Opium Barcelona nightclub. Prosecutors allege the footballer assaulted the woman despite her repeated pleas for him to stop and her clear indication that she did not wish to engage in sexual activity. Investigators reported the victim was in a state of shock.
The incident took place on the day Espanyol celebrated their promotion to Spain's top league. Club employees had organized a private celebration where the alleged incident occurred. News that the player was under investigation for suspected sexual assault became public in April of last year.
In addition to a prison sentence, the prosecution is seeking 65,000 euros in financial compensation for non-pecuniary damages and psychological consequences allegedly suffered by the victim. The case is currently in the indictment phase.
According to available information, five witnesses at the scene support the accused player's version of events, while two friends of the victim testified in court that the victim confided in them about the incident shortly after its alleged occurrence.
The footballer's defense previously challenged the decision to prosecute him, arguing there was insufficient evidence. The court will determine the player's guilt or innocence in further proceedings.
