Actress, husband sued for battery, assault and $5 million

A Los Angeles Airport staff has filed a lawsuit against both Martinez and Berry for not just battery, but also assault, negligence, and the intentional infliction of emotional distress.

Halle Berry and husband, Olivier Martinez have been sued for $5 million over an incident with an airport employee. The celebrity couple were served with the lawsuit on Monday, October 19.

We earlier reported that on January 4, Martinez shoved a car seat against a contract airport employee at the Los Angeles International Airport while trying to make way for his wife and children amidst a mop od paparazzi .

According to police report, the couple, Berry's daughter, Nahla and their son, Maceo were swarmed by the papz on their way out of LAX but required assistance from LA Police after a crowd of photographers and a contract airport staff came too close to the family to take pictures. Martinez was holding an empty car seat and reportedly pushed it against the contract airport employee causing him to fall backward.

Reports say the LAX staffer, Ronaldo Owens, was treated on the scene before being taken to a hospital. He filed a battery report against Martinez, but the Los Angeles City Attorney rejected the case for prosecution. Now, however, Owens has filed a lawsuit against both Martinez and Berry for not just battery, but also assault, negligence, and the intentional infliction of emotional distress.

In the filing, Owens’ attorney claims he was in no way interfering with the stars’ exit from the airport, but Martinez "abruptly turned towards Ronaldo and brutally and intentionally charged at Ronaldo using an empty child’s car seat he held in his hands as a weapon, striking Ronaldo to the ground with the seat and causing Ronaldo humiliation and injury."

To support the “humiliation” claim, the suit points to media coverage of the incident.
