While delivering judgment, Justice Bawale said the prosecution had successfully established the charge beyond reasonable doubt as required by law and said he refused to take into consideration the ill health of the convict who is said to be a cancer patient.

The judge said the punishment for the offense under section 283 of the penal code law attracted a maximum sentence of life imprisonment but opted to send Umar to prison for 10 years imprisonment without an option of fine to serve as a deterrent to others.

It was heard in court that the convict had lured the victim into his house on the pretext of buying mangoes from her and forcefully had sexual intercourse with her.
