On Wednesday, the Sarpy County Attorney's Office issued an official statement regarding Smith's arrest and the charges filed against him. As part of his bond conditions, Smith has been ordered to stay away from his wife and have no contact with her while legal proceedings are ongoing.

“During today’s bond hearing, a prosecutor from the Sarpy County Attorney’s Office presented the following information: It is alleged that on July 26, 2026, the defendant was involved in an altercation with his wife at a bar in Gretna, Nebraska, during which he threatened to kill her if she did not get into his vehicle and go home with him,” the statement read.

“Furthermore, he is accused of grabbing her and pushing her into the vehicle.

At one point during the drive, she managed to exit the vehicle. The defendant allegedly continued to make threats and insist she get back inside.

Upon arriving at their home, she again exited the vehicle. According to investigators, the defendant repeatedly attempted to strike her with the vehicle. His wife managed to move out of the way and avoid physical injury.”

An arrest warrant was issued on July 27, after which Smith voluntarily surrendered to authorities without incident.

Consequently, he faces three felony charges: attempted first-degree domestic assault, a Class II felony; making terroristic threats, a Class III-A felony; and first-degree false imprisonment, also a Class III-A felony.

Smith's next appearance in Sarpy County District Court is scheduled for August 17.

“As this case is pending in court, the Sarpy County Attorney’s Office will not provide further comment regarding the allegations,” the statement concluded.

“The defendant is presumed innocent unless and until proven guilty in a court of law.”

The 38-year-old Smith has had multiple stints in the UFC, including a highly successful run in the light heavyweight division that eventually earned him a title shot.

He retired from the organization after three consecutive losses but subsequently returned in April for a bare-knuckle MMA bout, where he defeated Chase Sherman.

Smith has not yet publicly commented on his arrest or the charges against him.
