Tom Brady's appeal to have his 'Deflategate' suspension case reheard has been rejected by the U.S. Second Circuit Court of Appeals.
The New England Patriots quarterback's four-game ban for his alleged role in deflating footballs used in their 45-7 win over the Indianapolis Colts in the 2015 AFC Championship was reinstated by a three-judge panel of the Second Circuit Court of Appeals in April.
Brady filed for a petition for a new hearing in May, but that has now been denied, leaving an appeal to the Supreme Court as his last option in his bid to overturn the suspension.
As it stands Brady will be unavailable for the season opener at the Arizona Cardinals as well as the home games against the Miami Dolphins, Houston Texans and Buffalo Bills, with Jimmy Garoppolo poised to deputise.
Brady is eligible to return in Week 5 as the Patriots travel to face the Cleveland Browns.
