The group's attorney, Ifeanyi Ejiofor, filed a suit before the Federal High Court in Abuja on Wednesday, September 27, 2017, asking the court to order the army chief for the return of the separatist leader.
He alleged that the IPOB leader has been missing since the military invaded Kanu's house in Umuahia on September 14 where 28 people were killed and several others abducted.
He said, "We just filed an application for prerogative order of habeas corpus commanding the Chief of Army Staff to produce Nnamdi Kanu in court."
Kanu has not been seen in public for over a week after the military's alleged invasion of his father's home in the Abia state capital.
Minister of Information and Culture, Lai Mohammed has dismissed the claims saying he suspects that the group's leader is in hiding.
Kanu, who is currently on bail on charges of treasonable felony, is expected to appear at the Federal High Court in Abuja on October 17 to resume trial.
He was granted bail by Justice Binta Nyako on Tuesday, April 25, with Senator Enyinnaya Abaribe, Jewish High Chief Priest, Immanuu-El Shalom Okabemadu and a Chartered Accountant resident in Abuja, Tochukwu Uchendu, signing his bail bond.
