Why Supreme Court dismissed governor’s case

The apex court, however dismissed the governor’s appeal after ruling that the tribunal was properly constituted and also that it had necessary jurisdiction to hear the case.

The Supreme Court of Nigeria has thrown out a case filed by Rivers State Governor, Nyesom Wike challenging the jurisdiction of the state’s Governorship Election Petition Tribunal to decide on events which occurred within the state while sitting in Abuja.

Wike, in his argument, also challenged the constitution of the tribunal’s panel.

The Supreme Court further explained that the tribunal was forced to relocate under the Doctrine of Necessity due to security concerns.

“…Evidence abound that there was serious security challenges prevailing in Rivers State which therefore called for the doctrine of necessity to be adopted,” the court held in a judgment read by Justice ‎Amiru Sanusi.

“I am unable to see any merit in this appeal and I hereby dismiss it without any order as to cost,” Justice Sanusi added.
