Giwa FC in May 2016 were expelled by the League Management Company (LMC) organisers of the league, from the 2016 season due to a breach of NPFL Framework and Rules as they failed to honour three cumulative fixtures without acceptable reason.

The expulsion was followed by a slew of court hearing before a fan of the club filed an application for an order to the court to cancel the season.

The plaintiff argues that the expulsion infringes on his fundamental human rights as a fan which has been injured by the LMC decision.

In a court hearing on Friday, January 27 Hon. Justice D.G. Mann, at Court No.3, has refused to even hear the application.

The Court upheld the arguments of LMC's Counsel, Mr. Olumide Olujinmi, that the Court should decline to assume jurisdiction to hear the application because the parties to the suit are currently before the Court of Appeal on several appeals arising from the original suit and also that, the Court of Appeal has reserved its ruling after hearing arguments on the same issues now brought before the lower Court by way of the application.

After hearing counter arguments from Mr Adzard Adzard, the Counsel to the plaintiff, Court had adjourned its ruling for delivery on 27th January 2017.
