Court discharges 2 men accused of causing grievous hurt, criminal trespass
He said that, neither the plaintiff or prosecutor have an explanation for their absence in court, hence he discharged the defendants.
The judge, Alhaji Umar Kagarko, ordered the release following an application by the defence counsel, Mohammed Farouk, who urged the court to strike out the case in line with Section 351 of Administration of the Criminal Justice Act(ACJA).The judge explained that the defendants were arraigned on Feb. 1 and adjourned the case till March 27, for hearing. The judge said that the matter was further adjourned on the request of the prosecutor, Fidelix Ogbubwe till April 18.
The judge advised that any aggrieved party can appeal through the High Court.
Yaro and Sadiq were arraigned on a five-count charge of joint-act, criminal trespass, criminal force and assault, causing hurt and mischief.
The prosecutor had told the court that the plaintiff had a disagreement with the defendants and reported the matter at the Garki Police Station on Jan. 28.
He said the defendants, however, evaded police invitation and criminally trespassed into the plaintiff’s room, beat her up and damaged her property.
The defendants pleaded not guilty.
