38-year-old Michael Suh and his 27-year-old lover, Nicole Germack were told to cease and desist by the officers but they decided to continue with the act.
The duo were apprehended after shocked onlookers saw them on the roof of the Chipotle Mexican Grill and called the police.
They have been charged with resisting arrest, lewdness, indecent exposure, loitering and conspiracy.
