Court strikes out eligibility suit against Jonathan

The case was struck out on Wednesday, February 11, after the four plaintiffs who instituted the suit expressed the desire to withdraw it.

A case instituted to challenge the eligibility of President Goodluck Jonathan to contest in the 2015 elections has been struck out by an Abuja Federal High Court.

The plaintiffs, Junaidu Mohammed, Tunde Samuel, Rasak Adeogun and Yahaya Ezeemoo Ndu, were also asked to pay N50, 000 as costs to Jonathan.

A motion for discontinuance of the case was filed on February 4 and was unopposed by Jonathan’s lawyer, Ade Okeanya-Inneh.

The plaintiffs had stated in their suit that Jonathan was ineligible for re-election ‎because another term in office would mean that he would rule longer than the eight years constitutionally provided for the President.

They stated further that another term would mean that Jonathan would take the oath of office thrice, as against the acceptable two times.

Jonathan became President in 2010 after the death of former ruler, Umar Musa Yar’adua. He was elected into the same office in 2011.
