Gaye’s son, Marvin Gaye III is planning to sue Empire creator Lee Daniels for stealing the show which he has described as his idea and brainchild.

According to TMZ, Marvin he registered a treatment for a show called Diamonds & Ballads (akaThose Sons of Riches!) in 2010 through the Writers Guild of America.

According to Marvin, the treatment describes a family in the music business "music based 'black' and 'hip' version of 'Dynasty' ... with a little 'Sopranos," TMZ reports.

Marvin's treatment show was based on the lives of his family and the Berry Gordy family.

According to TMZ, Gaye’s lawyer says he plans to file a lawsuit against Daniels, Fox network and every other person involved.

The family of late Motown legend Marvin Gaye successful sued Robin Thicke and Pharrell Williams' over their 2013 hit 'Blurred Lines'.

Earlier this year, an acclaimed Ghetto player, Ron Newt sued executive producers of FOX hit series, Empire, claiming the hit show is a carbon copy of his film, Bigger than Big.

'Empire' won the 'program of the year' award at the 2015 TCA.
