Music star wants herpes lawsuit dismissed
This comes a month after news broke that Usher allegedly gave an unidentified Georgia woman the herpes virus.
In legal documents, obtained by TMZ, Usher notes her lawsuit says nothing about whether she had been tested prior to their alleged sexual encounter.
He says, "A previous sexual partner very well may have already infected her."
And he also says she assumed the risk of getting herpes by having "casual, unprotected sexual intercourse and/or oral sex."
He's asking the judge to throw out her lawsuit.
The woman whose identity remains unknown initially sued the veteran R&B singer for $10 million but upped the amount after she tested positive to the STD.
According to the reports, the woman said she carried out the tests as soon as she heard that Usher had admitted that he has herpes simplex 2.
She first sued the singer after she claimed that they had unprotected sex earlier this year.
According to the legal documents, she is now suing him for emotional harm, medical bills and punitive damages.
