<h1>The Federal High Court sitting in Jos, on Thursday threw out a N1.25 billion damages suit filed by Gov. Rochas Okorocha, against the Inspector-General of Police (IGP) and the EFCC.</h1>

Okorocha filed the suit against the IGP and EFCC in November 2018 for allegedly invading and ransacking his house in Jos.

Delivering judgment, Justice Musa Kurya, dismissed Okoracha’s application for lacking in merit.

“Even though there was no record of how the search warrant was obtained but a search warrant dated May 3, 2017 from a Magistrate has been attached as exhibit before this court.

“Whether due process was followed or not at obtaining the search warrant, there is no proof otherwise to its genuineness and the breach of sections 34 – 37 of the UN human rights and African Charter.

“Consequently, judgement is hereby entered in favour of the respondents. The applicant’s claims are hereby refused.

“I hereby declare that the application of the applicant lacked merit and is hereby dismissed and cost is not awarded to either parties in this suit,’’ the Judge declared.

NAN reports that Okorocha alleged that the IGP and the anti-graft agency breached his fundamental human rights following the May 3, 2017 invasion.

Also joined in the suit are the Commissioner of Police Plateau, the Economic and Financial Crimes Commission (EFCC) and the Attorney General of the Federation and Minister of Justice.

The Governor prayed the court to declare the action of the police and EFCC as “illegal, null and void’’ and award his client the sum of N1.25 billion as general damages because there was no valid court warrant for such an exercise.

But the IGP and the EFCC, through their counsel, Edwin Inegbenoise and Muktar Ali-Ahmed, pleaded with the court to dismiss the governors application for lack of merit since a court warrant was obtained for the search on his residence in accordance with the law.

Okorocha filed the suit against the IGP and EFCC in November 2018 for allegedly invading and ransacking his house in Jos.

Delivering judgment in a case filed by another lawmaker, Abdu Sale, Justice Musa Kurya held that Baba-Hassan was not in the first qualified to contest the 2015 APC House Assembly primaries Jos North-North constituency of Plateau.

Saleh had in his suit filed through his Counsel, Mr David Ibeawuchi, told court that the lawmaker’s Diploma certificate in Business Administration allegedly obtained from University of Jos, which was presented to INEC for the 2015 election, was forged.

Mr Monday DamJan, Registrar, University of Jos, testified against the lawmaker, who was defended by Mr Solomon Umoh (SAN).

But Kurya in his judgment, found the evidence of the Registrar of the University to be uncontroverted, direct and positive and described him as “a witness of truth."

The Judge said that he also found that Diploma certificate paraded by Baba-Hassan which he presented to the INEC in 2011 and 2015 was forged which was why he (lawmaker) conspicuously expunged it from the 2019 form he submitted to INEC.

“Several controversies in the evidence of Hon. Ibrahim Baba- Hassan especially the purported Bachelor of Management Science degree with Second Class Lower division he presented through his counsel, Mr. Solomon Umoh (SAN) but in the semblance of the University Convocation booklet which he tendered it was indicated as Third Class.

“Although this did not relate to the claim of the plaintiff, which bothered on forgery of Diploma Certificate, Ibrahim Baba-Hassan did not state which one of the conflicting B. Sc degree the court is to believe,” the Judge stated.

The Judge also condemned the report of the Police Investigation tendered and described it as “very wrong” and “unreliable evidence” to counter the oral testimony of the Registrar.

According to him, “you cannot put something on nothing and expect it to stand. It will fall.”

The Judge also described the conduct of Baba-Hassan as unbecoming of a lawmaker and that he was not a witness of truth.

He however ordered the DSS, ICPC and law enforcement agencies to take note of his judgment which found the lawmaker guilty of forgery and to act appropriately.

Kurya granted all the reliefs sought by Saleh and made a consequential order directing Baba-Hassan to return all the salaries, entitlements and emoluments received by him and Ordered that 2 million naira be paid as costs to the plaintiff.

Part of the reliefs which the plaintiff sought was an Order disqualifying Baba-Hassan as the candidate of the APC, and an Order directing the INEC to recognize forthwith the name of the Plaintiff as the legitimate candidate of the APC for the 2015 elections into the State House of Assembly for Jos North-North constituency in Plateau State.

He further disqualified Baba-Hassan as the candidate of the APC, and an Ordered INEC to recognize forthwith the name of Saleh as the legitimate candidate of the APC for the 2015 elections into the State House of Assembly for Jos North-North constituency in Plateau.

<h1>Dr Matau Bernard-Malau, the Returning Officer, Plateau Central Senatorial District, on Monday night declared the National Assembly election in Kanam Local Government Area inconclusive.</h1>

Addressing Party agents, observers and INEC officials at the Pankshin Collation Centre, the returning officer, said that the decision became imperative due to the problems encountered while receiving the results from the area.

“We have various issues raised with the NASS result from Kanam; I believe this is the best option.

“INEC will decide what to do after receiving our reports on the results brought to us by the Collection Officer, Dr One Idowu,” Bernard-Malau said.

After the announcement, the returning officer packed his things to go when he was forced to put it down in writing for all agents to sign.

Bernard-Malau thereafter, directed his colleague, Dr Joseph Mangut, Returning Officer for the House of Representatives election, to put up the write up, which he signed and gave to the agents as a proof.
