Sheriff had filed the application in a bid to stop the Makarfi PDP from challenging an Appeal Court decision which named him as the rightful chairman of the opposition party.
However, the Supreme Court held that Sheriff’s application was invalid because the Makarfi appeal was properly filed.
The Appeal Court in Port Harcourt ruled in favour of Sheriff on February 27 and the Makarfi faction approached the Supreme Court to challenge the decision on March 16.
The apex court will now decide if Sheriff should lead the PDP or if the Makarfi faction is the legal authority in the party.
The PDP has been hit by a leadership crisis since May 21, 2016 when it attempted to remove Sheriff as chairman.
Meanwhile, Ekiti State governor, Ayo Fayose has vowed to leave the PDP if Sheriff wins at the Supreme Court.
