Appeal Court nullifies Senator’s election victory, orders rerun

Ekwunife’s victory had been challenged by Victor Umeh of the All Progressives Grand Alliance (APGA).

Uche Ekwunife

The Court of Appeal has nullified the victory of Anambra State Senator, Uche Ekwunife in the March 28, 2015 elections.

The judgment was delivered today, December 7, by Justice Datijo Yahaya in Enugu.

Ekwunife’s victory had been challenged by Victor Umeh of the All Progressives Grand Alliance (APGA).

In delivering the ruling, Justice Yahaya held that the Senator’s election did not meet the prescription of the electoral act.

He also said that the earlier decision of an election tribunal upholding Ekwunife’s victory was a perverse judgment, which could not stand.

The court has ordered the Independent National Electoral Commission (INEC) to conduct a fresh election within 90 days.
