Court orders immediate release of Radio Biafra boss

Justice Ademola, in his judgment, held that the continued detention of Kanu by the Department of States Services (DSS) was unlawful.

The Abuja Federal High Court has ordered the immediate release of Radio Biafra Director, Nnamdi Kanu.

The ruling was given by presiding judge, Justice Adeniyi Ademola on Thursday, December 17, 2015.

Justice Ademola, in his judgment, held that the continued detention of Kanu by the Department of States Services (DSS) was unlawful.

This comes a day after the Senior Magistrate Court in Wuse Zone 2 discharged Kanu of the allegationsbrought against him by the DSS.

“The accused person is hereby discharged and the case struck out,” Magistrate Shuaibu Usman ruled.

The DSS requested the court to discontinue Kanu’s trial on November 23, in order to charge him with terrorism before a higher court.

According to prosecution counsel, Moses Idakwo, the DSS had found some facts which showed that the accused had been involved in terrorism and had also been financing terrorism hence the matter was no longer under the jurisdiction of the court.

“The complainant is, therefore, applying to discontinue the matter under section 108(1) of administration of criminal justice act 2015.” Idakwo said.

The Radio Biafra boss was arrested in October and supposedly granted bail but he was never freed.

Kanu's continued detention has led his followers to launch protests in various part of the country to demand his freedom.
