Robbery suspect sues police

The respondents in the suit are the Lagos State Commissioner of Police and the Officer-in-Charge of SARS, Ikeja, SP Abba Kyari.

 

One of the suspects of the daring Lekki robbery of March 12th, 2015, Ebi Tosan has sought a court order, through his lawyer, Chief S.W. Baidi, directing the police to release him on bail.

Tosan who was part of the dare-devil gang that robbed the Lekki branch of First City Monument Bank, sued the police for N1m.

The respondents in the suit are the Lagos State Commissioner of Police and the Officer-in-Charge of Special Anti-Robbery Squad(SARS), Ikeja, SP Abba Kyari.

His claim is that it is “unlawful for the police to continue to keep him in detention without admitting him to bail.”

Speaking to newsmen, the suspect’s lawyer, Chief Baidi, said it is an “infringement and curtailment of the applicant’s constitutional right to personal liberty, freedom of movement and presumption of innocence.”

Tosan’s uncle, Tamuno Amos, who filed a  26-paragraph affidavit, claims that his nephew is being kept in police custody deliberately, to “extract a confessional statement from him on the alleged offence.”

Adding that “the applicant is suffering on daily basis without access to food, bath and other conveniences and he may die in custody unless granted bail.”
