The court also declined Justice Ofili-Ajumogobia’s request to declare the remand order issued by a magistrate court to detain her as unlawful and illegal.
In the suit, the judge seeks her immediate release from the custody of the Economic and Financial Crimes Commission (EFCC).
Justice Ofili-Ajumogobia was on Monday, November 28 arraigned before a Lagos State High Court in Ikeja for allegedly receiving N5 million from a senior lawyer.
Justice Hassan said: "The issue of the applicant’s bail from the EFCC custody has been overtaken by the event of her arraignment at the Lagos High Court and her subsequent release on bail by the court."
Justice Ofili-Ajumogobia’s request to declare the remand order issued by a magistrate court to detain her from November 10 till November 28 as unlawful and illegal was also declined.
The court explained that the remand order was in line with the provision of section 264(1) of the administration of criminal justice law of Lagos state, 2011.
The judge, however, condemned the EFCC for revoking the administrative bail earlier granted to Justice Ofili-Ajumogobia.
