Sgt Koti told the court that the accused and his partner in crime had an unlawful carnal knowledge of the girl when the victim was sent by her aunt to collect a crate of empty bottles of soft drinks from him.

"While on her way, Kamorudeen, who had connived with his accomplice, lured the complainant into a secluded place where they raped her after they had overpowered her.

Kamorudeen and his accomplice covered their victim’s mouth with a clothe to prevent her from raising an alarm that could have alerted passers-by about their action."

The prosecutor said it was the student that reported the crime to her aunt immediately after the incident and she reported the incident to the police authorities which led to the arrest of the accused.

The prosecutor said the offences contravened Sections 137 and 409 of the Criminal Law of Lagos State, 2011.

Section 137 of the criminal law of the state reads thus:

'Any person who has sexual intercourse with a child is guilty of a felony and is liable to imprisonment for life.'
