Man who claimed girlfriend raped him loses case

A man who took his girlfriend to court on rape allegation has lost the case as the judge reasons he must have enjoyed it.

A German has had a rape case he preferred against his girlfriend nullified.

A 49-year-old German man identified only as Thomas, has lost a case of rape he filed against his 39-year-old girlfriend, Cecelia, because the judge thought he must have enjoyed the sex believing he was in a dream.

Thomas had filed the case claiming that he woke up one night after he had been sterilised and found his girlfriend riding him on the sofa, causing him serious pains.

Calling her a 'nympho from hell', Thomas said Cecelia loved sex so much and wanted it all the time.

During the hearing, Judge Leberecht Staupe expressed his surprise at the case, telling the court:

"Sexual matters usually see men in the dock. I must admit I have never experienced such a case."

Thomas told the court that he was alone at home with the single mother and in the middle of the night while he was still asleep, he woke in pain to find Cecelia on top of him.

He said:

"It hurt, because ever since I was sterilised, it hurts me if the woman is on top.

I remember being in a deep sleep, having a nice warm dream, when I woke to find her riding me.

She is a nympho from hell, she takes what she wants."

Cecelia, who hid her face behind a fild folder during the trial, argued that her partner was not asleep and that they enjoyed an active sex life.

Cecelia also told the court that she never thought 'sex' would land her in court:

"I never had so much sex with anyone before - in the cellar, on the balcony, but no-one ever got hurt.

We had fantasies that we swapped every day. He liked taking me when I was unawares."

In dismissing the case, Judge Staupe said:

"Maybe he enjoyed the act and thought he was in a dream.

Not until today did he say he had been injured during the act. Sexual relations between people can be complicated."
